This Agreement and Release of Liability (“Agreement”) is entered into on the date signed below by and between NYC Adventure Bike Tours LLC d/b/a NYC Adventure eBike Tours (“NYC eBike Tours”) and the individual signing this Agreement (“Participant”).

By signing this Agreement, Participant acknowledges that they have read, understand, and agree to all terms and conditions contained herein.

1. Assumption of Risk

Participant acknowledges that riding an electric bicycle (“eBike”) and participating in guided tours involves inherent and unavoidable risks, including but not limited to:

These risks may result in serious bodily injury, illness, property damage, paralysis, or death.

Participant voluntarily assumes all risks associated with operating an eBike and participating in a guided tour, whether known or unknown.

Participant acknowledges that they have had the opportunity to inspect the eBike and all associated equipment prior to use.

Participant accepts the equipment in good working condition and assumes full responsibility for the equipment from the moment it is issued until it is returned to NYC eBike Tours.

Participant agrees to pay for any damage, loss, or theft of the equipment, excluding normal wear and tear.

If the eBike is lost, stolen, or not returned for any reason, Participant authorizes NYC Adventure eBike Tours LLC to charge up to $2,500 to the credit card on file to cover replacement costs.

NYC Adventure eBike Tours LLC is expressly authorized to charge the credit card on file for any:

Participant represents and warrants that they:

Participant agrees to operate the eBike in compliance with all applicable federal, state, and New York City laws, including all traffic rules and regulations governing bicycles and electric bicycles.

Failure to follow safety instructions may result in immediate termination of the tour without refund.

NYC eBike Tours reserves the right to terminate a participant’s ride if staff determines continued participation may create a safety risk.
