Strykers Shooting World Liability, Risk, and Indemnity Agreement

A. LIABILITY, RISK AND INDEMNITY AGREEMENT

Please Read And Agree To The Following Statements.

In consideration of the services of Showme, LLC range on the premises of Strykers Shooting World, and their assigns, including but not limited to their agents, owners, officers, directors, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree to release and irrevocable discharge Showme, LLC and Stryers Shooting World on behalf of myself, my children, my parents, my heirs, assignes, personal representatievs and estate without reservation as to the following disclosures:

1. I am not legally prohibited from possessing firearms or ammunition by any provision of the laws of the United States of America, the State of New Mexico, the State of my residence (if other than NM), or any other laws, statutes, regulations or legal proceedings pending or contemplated against me whatsoever.

2. I am not party to any legal action, whether civil or criminal; party to or under a protective or restrainting order.

3. I am not a convicted felon, or on probation.

4. I am not under medical supervision or care that would legally prevent, or make it ill-advised for me to participate in activities involving

I acknowledge that shooting and the activities on the range entail known and unanticipated risks, which would result in physical or emotional injury, paralysis, death, or damage to my property, myself, or to third parties and their property. I understand and accept that such risks are inherant to this activity. (The risks include, but are not limited to: the undersigned or third parties being shot by a firearm; suffering hearing loss; eye injury or loss; inhalation or contact with airborne contaminants and/or flyign debris; slipping or falling.)

6. I expressly agree, accept, and assume any and all risks inherant to this activity. My partcipation is purely voluntary, and I elect to participate in spite of the risks both known and unknown.

7. I accept, acknowledge, and understand that Showme, LLC along with Strykers Shooting World have taken the necessary precautions to provide a safe environment; their employees and range attendants seek safety, but are not infallible. They might be unaware of a participants abilities, may give inadequate warnings and instructions, or the equiptment being used might malfunction.

8. I hereby voluntarily release, forever irrevocably discharge, agree to indemnify, and hold harmless Showme, LLC and Strykers Shooting World and their assignees, indivdiually and collectively, of any and all claims, demands, or causes of action, which are in any way connected with or may arise as a result of my participation in this activity, or my use of the Showme, LLC range on the premises of Strykers Shooting World equiptment, range or facilities, including any claim which alleges negligent acts or omissions of Showme, LLC or Strykers Shooting World.

9. Should Showme, LLC, Strykers Shooting World, or anyone acting on their behalf incur costs, or reasonable attorneys fees, to enforce or seek relief under this agreement, I agree to idemnify and hold them harmless for all such fees and expenses.

10. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in this activity. In the absense or deficiency of such coverage, I agree to bear the cost of such injury or damage myself.

11. I certify I have no medical or physical conditions which could interfere with my safety in this activity or else I am ready to assume and bear the costs of all risks that may be created directly or indirectly by any such condition.

12. I understand that the rules of the range are conspicuously posted on the premises and I agree to follow such postings at all times. I understand that I may request a paper-copy of the range rules to review at any time.

13. I am familiar with and understand the functioning, use, and operation of each firearm that I personally choose to use on the premises.

14. This is a broad release of any and all liability, claims, actions, damages, costs or expenses of any kind as result of my activity, whether intended, negligent, or accidental.

15. I acknowledge that the Showme, LLC range on the premises of Strykers Shooting World would never grant me access if it had reason to suspect that ANY of these affirmations were untruthful in any way. Should I violate any of these affirmations, I accept full and sole responsibility for my actions and I agree to allow Showme, LLC and/or Strykers Shooting World to publish this document in any form whatsoever to demonstrate such dishonesty and misrepresentations in an effort to seek damages in a competent jurisdiction.

16. I certify I am not working on behalf of the New Mexico Department Of Public Safety as either a range or concealed carry class auditor or inspector.

17. I have had sufficient opportunity to read and thoroughly understand this entire agreement. I understand that I may have legal counsel review this document prior to my signing if desired.

FAILURE TO ABIDE BY THE RANGE RULES OR STAFF DIRECTIVES MAY RESULT IN HAVING YOUR FIREARM CONFISCATED, LEGAL ACTION, OR BEING BANNED FROM FURTHER USE OF THE SHOWME, LLC RANGE ON THE PREMISES OF STRYKERS SHOOTING WORLD AND ITS FACILITIES.

BY SIGNING THIS DOCUMENT, I UNDERSTAND THAT I WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION ON THE BASIS OF ANY CLAIM FROM WHICH I HAVE RELEASED SHOWME, LLC AND STRYKERS SHOOTING WORLD HEREIN.

The laws of the State of New Mexico shall govern this agreement. Should any part of this agreement be held in whole or in part to be unenforcable for any reason, the remainder of that provision and the entire agreement will be severable and remain in full effect.

B. Showme LLC Terms And Conditions For Those Seeking Range Memberships. Please read this section if you will be signing up for a range membership of any type.

1. The Showme LLC range (SHOWME) is available for use by all SHOWME Members. Guest of Members, private citizens groups and by the general public. SHOWME Memberships are available to provide preferred access, discounts for merchandise of Strykers Shooting World, services and facility use, and other benefits. SHOWME Membership is subject to the Membership Terms and Conditions stated herin. Membership will be granted, and may be revoked, at the sole discretion of Showme LLC range personnel and/or Strykers Shooting World.

2. As part of the consideration for Membership, the Member herby agrees to remain a Member for a period of not less than one (1) year from the date of the Agreement. SHOWME is entitled to recover its costs, including reasonable attorneys fees, incurred in collecting sums due to SHOWME under this or any other Membership provision or otherwise.

3. All members, Guests, and other SHOWME facility users must obey the SHOWME Range Rules and must review, agree to the terms of, and sign the Adult Release, Assumption of Risk and Indemnity agreement. Furthermore, all first-time Members, Guests, and other SHOWME facility users MUST participate in the SHOWME LLC Range orientation.

4. All Guests must be accompanied by a Member to be admitted to the firing line. Members are responsible for all actions taken by their Guests and will hold SHOWME LLC and Strykers Shooting World harmless for property damage, accidents and injuries to or caused by Guests.

5. All Members and Guests are subject ot the general policies and rules of operation and administration of SHOWME, all of which are intended to provide a safe, professional, friendly and family-oriented club environment.

6. Any Member and Guest of a Member may be suspended or expelled from the range and/or facility, for violation of the Range Rules or for behavior deemed unsafe by SHOWME personnel. Decisions of SHOWME and/or Strykers Shooting World regarding suspension or expulsion are final.

7. Any destruction of SHOWME LLC or Strykers Shooting World property caused by a Member or a Members Guest, whether accidental, negligent, and willful or otherwise, may result in the violator being removed from the range and/or facility, suspended or removed from Membership if a Member, and/or criminally prosecuted. In additon, SHOWME reserves the right to asses to the Member a resonable charge for any such damage, regardless of whether the damage is caused by the Member or the Members Guest.

8. All Members must allow their photograph to be taken for SHOWME records and identification.

9. A Standard Membership may not be transferred or sold.

10. All Members and guests must present a current photo ID in order to access the Range.
