1 . Definitions. The person who is participating in the Activity as defined in this paragraph shall be referred to hereinafter as “Participant.” The “Undersigned” means only the Participant when the Participant is age 18 or older OR it means both the Participant and the Participant’s parent or legal guardian when the Participant is under the age of 18. “Released Parties” mean Bahamas Lodge Limited, Irwin Backcountry Guides LLC, Silver Sides LLC, Silver Sides Holdings LLC, Mangrove Cay Limited, Bahama Lodge LLC, CS Irwin LLC, and Grassy Creek LLC, and their respective successors in interest, affiliated organizations and companies, insurance carriers, agents, employees, representatives, assignees, officers, directors, members, shareholders, contractors and sub-contractors. “Bahama Watercraft Activities” The “Activity” means any and all activity and excursion offered or arranged by the Released Parties, including, but not limited to, water sports of all kinds, inclusive of boating, fishing, snorkeling, paddle boarding, swimming and kayaking, biking, cliff jumping, caving, and hiking; and and/or using the equipment, property, premises and facilities of the Released Parties for any purpose, whether associated directly or indirectly with the activity.
